1. INTRODUCTION

Discovery Foundation (discoveryfoundation.eu) is committed to protecting your privacy, as such, it only collects personal information from those who voluntarily provide it, and only uses it for the purposes for which it was provided.

Aware of the importance of transparency in the data processing processes of its Clients and other interested parties, Discovery Foundation has outlined a Personal Data Privacy Policy that covers the way in which personal information is collected, used, disclosed, transferred and stored.

In this context, it is intended to make publicly known the general rules for the processing of personal data collected in strict respect and compliance with the provisions of the personal data protection legislation in force, namely Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (“GDPR”).

All data collected will be listed in this policy in a transparent manner and with full respect for the rights of the holder.

2. CONCEPTS

For the purposes of this Privacy Policy and the General Data Protection Regulation (RGPD), it is understood:

«Personal data», information relating to an identified or identifiable natural person («data subject»); An identifiable person is identifiable, directly, or indirectly, by reference to an identifier, such as a name, an identification number, location data, electronic identifiers or one or more specific elements of the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

«Processing» means an operation, or a set of operations carried out on personal data or on sets of personal data, by automated or non-automated means, such as collection, registration, organization, structuring, conservation, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or any other form of making available, comparison or interconnection, limitation, erasure or destruction.

«Processing limitation», the insertion of a mark in the personal data stored with the aim of limiting its treatment in the future.

«Profiling» means any form of automated processing of personal data consisting of using such personal data to assess certain personal aspects of a natural person, to analyze or predict aspects related to their professional performance, their economic situation, health, personal preferences, interests, reliability, behavior, location, or travel.

«Pseudonymization» means the processing of personal data in such a way that they can no longer be attributed to a specific data subject without recourse to supplementary information, provided that such supplementary information is kept separately and subject to technical and organizational measures to ensure that the personal data cannot be attributed to an identified or identifiable natural person.

«File» means any structured set of personal data, accessible according to specific criteria, whether centralized, decentralized or distributed functionally or geographically.

«Controller» means the natural or legal person, public authority, agency, or other body which, individually or jointly with others, determines the purposes and means of processing personal data.

«Subcontractor» means a natural or legal person, public authority, agency, or other body that processes personal data on behalf of the controller.

«Recipient» means a natural or legal person, public authority, agency, or other body that receives communications of personal data, regardless of whether it is a third party. However, public authorities that may receive personal data within the framework of specific inquiries under Union or Client State law are not considered recipients; the processing of such data by these public authorities must comply with the applicable data protection rules depending on the purposes of the processing.

«Third party» means the natural or legal person, the public authority, the service, or body other than the data subject, the controller, the processor, and the persons who, under the direct authority of the controller or processor, are authorized to process personal data.

«Consent» of the data subject, a free, specific, informed, and explicit expression of will, by which the data subject accepts, by means of an unequivocal positive statement or act, that the personal data concerning him are subject to treatment.

«Personal data breach» means a breach of security that causes, accidentally or unlawfully, the unauthorized destruction, loss, alteration, disclosure, or access to personal data transmitted, stored or subject to any other type of treatment.

«Genetic data» means personal data relating to the genetic, hereditary, or acquired characteristics of a natural person which provide unique information about the physiology or health of that natural person, and which result from an analysis of a biological sample from the natural person in cause.

«Biometric data», personal data resulting from a specific technical treatment relating to the physical, physiological, or behavioral characteristics of a natural person that allow or confirm the unique identification of that natural person, namely facial images or dactyloscopy data.

«Health data» means personal data relating to the physical or mental health of a natural person, including the provision of health services, which reveal information about their state of health.

3. COMMITMENT BY DISCOVERY FOUNDATION

Discovery Foundation respects the best practices in the field of security and protection of personal data and, for this purpose, has taken the necessary technical and organizational measures to comply with the RGPD and guarantee the protection and confidentiality of the personal data to which it has access in compliance of their statutory obligations, ensuring that their processing is lawful and transparent.

The rules provided for in this Personal Data Privacy Policy complement the provisions, in terms of protection and processing of personal data, provided for in the contract(s) entered into between Discovery Foundation and its Clients, in the employment contracts with its employees and in Discovery Foundation’s relationship with all interested parties, as well as the rules set out in the terms and conditions that regulate the offer of the various products and services and which are duly published.

The content of this Guide is merely informative and guiding and does not relieve consultation of the applicable legislation.

4. PROCESSING OF PERSONAL DATA AT DISCOVERY FOUNDATION

The processing of personal data consists of an operation or set of operations carried out on personal data or sets of personal data, through automated means, or not, namely the collection, registration, organization, structuring, conservation, adaptation, retrieval, consultation, use, disclosure, dissemination, comparison, interconnection, limitation, erasure, or destruction.

6. COLLECTION AND USE OF PERSONAL INFORMATION

Discovery Foundation develops a continuous work to guarantee the security and confidentiality of the data provided by the respective holders, treating the information in the legally foreseen terms. Members may be asked to provide personal information whenever they are in contact with Discovery Foundation. The Member is not obliged to provide the requested personal information, but if they choose not to do so, they may not be able to access the services made available to them by Discovery Foundation, namely accessing the online electronic services available on the website as well their reserved area on the Discovery Foundation web portal or answer any questions they may have.

7. PURPOSES OF PROCESSING PERSONAL DATA AND RESPECTIVE LEGAL BASIS

In general, the personal data collected are based on the management of the relationship with Customers, the provision of services, the adequacy of services to the needs and interests of data subjects, namely for the purpose of accessing specific functionalities of the services provided, suggestions content, training actions, events and workshops related to the areas of expertise and specialization of Discovery Foundation. Additionally, personal data may also be processed for the purposes of complying with legal obligations and for disciplinary purposes, investigation, detection, and repression of serious crimes.

8. TYPES OF PERSONAL INFORMATION WE COLLECT

Within the scope of the services provided on the website, various information is collected, namely the name, tax number, telephone contact, photograph, email address, tax address and citizen card number or identity card.

Data from your academic and professional career may also be collected, namely:

Course, teaching establishment, and date of completion of the same, names and dates of completion of all actions attended.

For Customers who choose the option of charging services or fees by direct debit, the following data is also collected: IBAN, bank name and SWIFT code.

9. PROTECTION OF PERSONAL INFORMATION

Discovery Foundation takes the security of its Customers’ personal information with the utmost rigor and seriousness. The online services provided by Discovery Foundation to its Customers ensure the protection of their personal data during the exchange of information through encryption, such as Transport Layer Security (TLS). At the same time, data is stored using computer systems with limited access and housed in facilities subject to physical protection measures.

We do not intend to knowingly collect information from children.

11. INTEGRITY AND RETENTION OF PERSONAL INFORMATION

Discovery Foundation allows Customers to easily maintain accurate, complete, and up-to-date personal information. The personal information of each Customer is kept for the period considered necessary to fulfill the purposes indicated in this Personal Data Privacy Policy, except if, by law, a longer retention period is necessary or permitted.

12. ACCESS TO PERSONAL INFORMATION

Customer can help ensure that contact information and preferences are correct, complete and up-to-date by logging into their account on the website.

Requests that are spurious or vexatious, that endanger the privacy of others, that are extremely difficult to fulfill, or for which access is not otherwise required by law, may be refused processing.

13. USE OF PERSONAL INFORMATION

The personal information that Discovery Foundation collects, allows it to keep an updated record of its Customers.

Personal information is also used to help create, develop, use, make available and improve the services provided by Discovery Foundation, namely the dissemination of events, campaigns, promotions, and other initiatives.

When registering on the online platform (company website), various personal data are used to uniquely identify the Customer and, in this way, give them access to his reserved area where they can consult all their data, as well as interact with the different services. 

Discovery Foundation may use personal information for internal purposes, such as audits, data analysis, among others.

The personal data collected can be processed by computer and in an automated or non-automated way, guaranteeing, in all cases, strict compliance with the legislation on the protection of personal data, being stored in specific databases, created for the purpose and, in a situation. Under no circumstances will the data collected be used for any purpose other than the one for which they were collected or given consent by the data subject.

14. CONSERVATION OF YOUR PERSONAL DATA

There are legal requirements that require the retention of data for a minimum period of time. Thus, and whenever there is no specific legal requirement, the data will be stored and kept only for the minimum period necessary to pursue the purposes that motivated its collection or subsequent processing, under the terms defined by law.

15. RIGHTS AS HOLDER

As holders of personal data, Customers are guaranteed, at any time, the right to access, rectify, update, limit and erase their personal data (except when the data is indispensable for the pursuit of OE’s statutory attributions and other legal obligations, and which are duly identified as being mandatory), without this compromising the lawfulness of the treatment carried out under that consent.

16. ACCESS, RECTIFY, UPDATE, LIMIT, DELETE, OPPOSITE THE TREATMENT OF YOUR PERSONAL DATA, OR REMOVE CONSENT

Without prejudice to the provisions of the RGPD, the holder of the personal data may do so, directly on the company’s website or upon written request, addressed to the respective Responsible for the treatment, through the contacts made available for this purpose in this document, as well as other contacts made available by Discovery Foundation.

17. OPPOSITION TO RECEIVING CONTACTS FOR DISCLOSURE PURPOSES

Discovery Foundation can promote actions to publicize its Customers about new products, services, events, campaigns and training actions, namely by telephone, postal mail, email, SMS, MMS or any other electronic communications service.

If the holder of personal data does not wish to continue receiving these communications, he may, at any time, withdraw his consent to the use of his data for these purposes.

18. COMPLAIN

Without prejudice to being able to present complaints directly to Discovery Foundation through the contacts made available for this purpose, the Data Holder can complain directly to the National Control Authority, which is the National Data Protection Commission (CNPD), using the contacts that can be found online.

19. TRANSFER OF YOUR PERSONAL DATA

The provision of certain services by Discovery Foundation may imply the temporary transfer of part of your data outside Greece, including outside the European Union or to International Organizations.

In such case, Discovery Foundation will strictly comply with the applicable legal provisions, namely regarding the determination of the suitability of the destination country(ies) regarding the protection of personal data and the requirements applicable to such transfers, including, whenever applicable, the signing of appropriate contractual instruments that guarantee and respect the legal requirements in force.

20. CHANGES TO THE PERSONAL DATA PROTECTION POLICY

Discovery Foundation reserves the right, at any time, to make adjustments or changes to this Personal Data Privacy Policy, these changes being duly publicized in Discovery Foundation’s various institutional communication channels.

21. DISCLOSURE TO THIRD PARTIES

Occasionally, Discovery Foundation may make certain personal information available to strategic partners, for the dissemination of campaigns, events, training, and various activities. In this case, the only personal information made available is a very limited universe of data, namely the name, email address.

Discovery Foundation may also have to disclose personal information of its Clients in accordance with the legislation, legal process, dispute resolution and/or requests from public or governmental authorities, inside or outside the Client’s country of residence. Information about the Customer may be disclosed if it is determined that such disclosure is necessary or important, whether for the purposes of national security, law enforcement or other aspects of public interest.

Discovery Foundation may have to disclose information about its Clients in order to comply with the statutory obligations to which it is bound.

22. DISCOVERY FOUNDATION’S GLOBAL COMMITMENT TO THE PRIVACY OF ITS CUSTOMERS AND EMPLOYEES

To ensure that its Customers’ personal information is protected, Discovery Foundation regularly communicates the privacy and security guidelines to its employees, promoting awareness of this matter and in order to ensure that individual and collective behaviors safeguard the strict application of this Policy of Personal Data Privacy.

23. OF THE LAW

This privacy policy complies with the applicable legislation on privacy and the processing of personal data. In this sense, it may be revised at any time due to changes in the legal regulations that support it, as well as the recommendations of the competent national and international entities in the matter.

When there are changes to this privacy policy that change its version, the Customer will be notified via general email or through the institutional website.
